AREAS OF PRACTICE AND EXPERIENCE 

Philip has acted on behalf of the Construction Industry as a Solicitor for 34 years.  As well as being a Hunt ADR Construciton Adjudicator, he is an adjudicator on five other national panels comprising:

Philip was an Adjudicator under the 1981 With Contractor’s Design JCT  ADJUDICATION Form of Building Contract before the HGCRA 1996 was enacted. He has made over 100 Decisions as Adjudicator, in England, Scotland and Northern Ireland since 1998 and have been appointed Adjudicator in many adjudications which have settled.
 

He has dealt with major disputes under PFi Contracts and other major projects, including Framework Agreements.
He made a Decision governing the waste treatment policy of a Scottish Local Authority over five years and another governing a public infrastructure project affecting the whole of Northern Ireland for the foreseeable future.  He also routinely adjudicate smaller disputes under main contracts and sub-contracts, over payment, delay, loss and expense and defects and routinely deals with disputes between Architects and their clients.


He helped to provide training for the initial RIBA Adjudicators panel following the enactment of the HGCRA 1996, at the invitation of the RIBA.  He is a member of the Adjudication Society, and a founder member of its West Midlands branch.

 

Philip is a Chartered Arbitrator on many panel lists including The Law Society, Institute of Chartered Accountants, The Institute of Chemical Engineers and the CIArb and has been a Fellow of The Chartered Institute of Arbitrators since 1994.

 
Philip is a Mediator, accredited by CEDR since 2000 and he is on many panel lists including the RIBA’s list of mediators.  He has conducted over 100 mediations, of which only five did not settle. Philip runs a mediation scheme for the Coventry and Warwickshire Chamber of Commerce.
 

Philip is on the CIArb DRB Panel.  I am also on several ad hoc panels and boards for example the Wakefield PFi panel.

Co-author of a book on Professional Negligence.
Contributed to a book on set-off in the construction industry.
Contributed to a Lloyd’s Practical Guide on Professional Negligence and Insurance Law.
Papers published in The Law Society Gazette, Construction Law Journal, Society of Construction Law Publications and The Academy of Experts Journal.
Articles also published in The Chartered Institute of Arbitrators Journal and specialist trade journals including Building Magazine.

 

LECTURES

Philip is a prolific lecturer and has lectured for the RICS, RIBA, Institution of Structural Engineers, Engineering Employers Federation, the National Grid, Construction Industry Training Board and Lloyds of London.
